COMMISSION TOS

Please read the Terms of Service before commissioning me!

By owning a design / commissioning art created by me, user @VictoryDrawsManga ("the Designer"), you ("the Owner") affirm to have read and agree to be bound to the Terms of Service listed below.

Failure to abide by the Terms of Service (TOS) may result in a blacklist and/ or a public service announcement (PSA).

Note that Terms of Use may be subject to change without prior notice, though exceptions may be made.

These Terms of Use are in effect and up to date as of MAY 02, 2022.

ART TOS SECTION

By purchasing from me, you are agreeing you have read these Term of Services! (Some part's of the TOS are in bold for easier understanding.)

1. I have the right to decline any commission request I find that is deemed by me uncomfortable, inappropriate, or beyond my skills / limits.

2. For Discord Nitro AND Toyhou.se Premium payment(s), the payment of Discord Nitro or Toyhou.se Premium is to be sent first before I begin the commission.

 

3. For PWYW voucher payment option, the commission will be started after I receive confirmation from you (the buyer) and the artist being payed for the commission voucher that the payment for the vouchered commission has been sent.

4. The commissioned art is for PERSONAL USE only. Commercial usage with the commissioned art is not allowed. (Selling, producing, etc for monetary gain.) Usage as an icon / profile picture , reposting , is allowed so long as I (the artist) is given credit. (Example: "VictoryDrawsManga on Toyhou.se / TH")

5. Nothing made by the artist (VictoryDrawsManga) may be used in any blockchain technology including but not limited to NFTS, cryptocurrency, etc.

 

6. Unless told otherwise , I may use the commissioned work as commission examples on this site and/or post it on my social media . Posted commission work will be covered with a watermark. The client will receive a version of the commissioned art with and without the watermark. Do let me know if I can or cannot post it on my social medias / use the commission work as an example.

7. The client will be receiving a digital file (.png) artwork via the social they contacted me on (unless discussed otherwise) . JPG file can be sent if requested. The commissioned work cannot be physically shipped to the client, as this is a digital work commission.

8. I can send three types of Work In Progress (WIP) shots upon request in order: Sketch, Lineart, Base Color. You can request me to send a Lineart and/or Base color WIP, Sketch WIP is automatically given. 

 

9. I can make revisions during the sending of the Sketch WIP. I can make 

up to THREE REVISIONS so long as they are small and not much work.

Anchor 1

CUSTOM DESIGN TOS SECTION:

  1. The Terms of Service only affect an owner after it has taken effect. Edits made to the TOS do not affect any owners of designs made BEFORE the edit date. (EX: Edits to the TOS made on May 2nd do not affect any owners of my designs made before May 2nd, but affect owners of designs made after May 2nd)

  2. You may make both major and minor edits to the design/ redesigns. Any redesigns do not need explicit permission from me, though asking is appreciated.

  3. You may regift , retrade, or resell the commissioned design made. If the design is not a custom commission, the Owner can only trade or resell if Additional Value (trades, commissions, personal art) has been added. Free / Gifted Art (Art in which the Owner does not give anything in exchange, this includes art from Art Fight or similar events.) does NOT count as additional value. Additional value must be added to the character gallery.

  4. You may only resell the design for the same price as bought / commissioned for UNLESS additional value is added and is in the character gallery.

  5. You can use the design for personal/ non-commercial use only UNLESS the Owner has discussed commercial usage with the Designer and has paid the required fees for commercial usage.

  6. You may not claim the original design as your own nor claim the original artwork as your own work.

  7. You may not make any edits to the original artwork. (Redesign are still okay in this case!) But do not draw over my artwork. (Art drawn by me, @VictoryDrawsManga )

  8. If uploading the original artwork off-site, credit to the Designer (VictoryDrawsManga) must be provided; do credit me with the proper usernames based on which social you are posting on. (Twitter: @VictoryDraws, Pixiv: @VictoryDraws , Toyhou.se: @VictoryDrawsManga )

  9. I only claim ownership of the original design concept/ execution. I do not claim ownership to any redesigns and/ or the character/ associated character of the design.

  10. I acknowledge that once a design is owned by the Owner, the design/ character no longer belongs to me. I also cannot “claim back” a design.

  11. Like for Art Commissions, I may use the commissioned or traded design as commission examples on this site and/or post it on my social media . Posted work will be covered with a watermark. The client will receive a version of the art with and without the watermark. Do let me know if I can or cannot post it on my social media / use the commission work as an example.

  12. If the design is bought as a Fandom OC (OC made for any specific fandom media) you are allowed to convert the design into a Non Fandom  OC or a Fandom OC for a different fandom.

  13. You are allowed to convert the design to a Closed Species (CS) , so long as it is an existing CS (for creating a CS using one of my designs, please discuss with me beforehand.) . I cannot add CS traits as of this TOS being effective, though you are allowed to commission / work with other artists for that purpose.

What I can and cannot draw for commission works!

I CAN DRAW:

  • OCs (Original Characters)

     

  • OC x Canon

     

  • Human / Humanoid OCS

     

  • Any genders

     

  • Canon x Canon Fanart

     

  • Mild Gore (Blood, Minor Injuries)

     

  • Young to Middle Aged Characters

     

  • Mild Violence (Battles / Duel scenes, etc)

I CAN'T DRAW:

  • Furries , Anthros, Animal Characters

    ​

  • Heavy Gore

     

  • Elderly Characters

     

  • Realistic / Realism Style

     

  • Heavy Mecha , Armor, Etc

     

  • Extremely detailed designs that are beyond my limits.

  • Heavy / Extreme Violence

I WILL NEVER DRAW:

  • Fetish , Hateful , Bigotry , Offensive Art / Themes

     

  • NSFW (Especially NSFW of minor characters, suggestive art is included )

     

  • Extreme Violence

Other important information to be known about commissioning me!

OTHER INFORMATION:

    Weapons, Objects, Items, etc can be drawn in the illustration with an additional fee (Detail Fee). Check Commissions Options for fee prices.

    If wanting an weapon, object, item, etc to be drawn in the commission work please specify what it is and give references if possible.

     

  •  

    There is no set deadline for commission work as I am a student trying to live a life, work on her Webtoon series, work on owed art for others, and commissions whenever they come.  However, on each Commission Option there is an estimated time, but work's may take longer than the estimated time. Do not commission me if that makes you uncomfortable.

  •  

    Due to being busy most of the time, I do hope that the Client will be respectful of me. I will try and be as communicative as possible during the process, and I hope the Client will make the same effort. 

  • ​

    Feel free to ask for WIP's, updates, etc, anytime! I will try my best to be as clear as possible with how progress is going! :D

  • ​

    A rush fee can be payed if you want the commission to be done within 1-3 days, being double the base price. Check Commissions Options for specific rush fee prices. However, this option may be unavailable at times.

    A fee for more detailed designs may be added if you're character is deemed as "extra detailed" by me

    . Feel free to ask me if you're character is to be deemed as "extra detailed", as I am actually lenient with this term, no charge at all! Check Commission Options for details fee prices.

DISCLAIMERS:

​

  • ​I retain all rights to my art.

     

  •  

    I do NOT accept refunds, please be sure that you are wanting to purchase from me.

​

  • Commissions will typically be drawn on a 780 x 1200 PX canvas for Fullbody and Thigh-Up options, and 780 x 780 PX for Halfbody and Bust Up options and canvas size heavily varies for Custom Design Commissions. This may be subject to change.

​

  • ​

    Terms of Service may be subject to changes or adjustment's officially at times, or during discussion between me and the client.
